Program Agreement

This Agreement begins upon purchase of any Implement, Elevate, Ascend mentorship or membership option.

Robert Kress LLC and Longevity Publishing LLC (herein referred to as “Consultant,” “Company,” “we,” or “us”) agree to provide the program Implement, Elevate, Ascend and related membership offerings (herein referred to collectively as the “Program”). By enrolling in the Program, Client (“you”) agrees to abide by all policies and procedures as outlined in this Agreement as a condition of participation.

The Program

The Program is a mentorship, education, and consulting experience designed to support pharmacists and other practitioners in building and growing a functional medicine practice. It may include, as applicable:

Group coaching calls
One-on-one consulting calls
Recorded trainings, live trainings, and Q&A sessions
Implementation frameworks, templates, and resources
Access to an online portal and/or community

Scope of Services & Role of Consultant

Robert Kress, as Consultant, is not an employee, agent, lawyer, doctor of medicine to the Client, therapist, public relations or business manager, registered dietician, financial analyst, psychotherapist, or accountant. Client understands that Consultant has not promised, shall not be obligated to and will not:

Procure or attempt to procure employment, specific business results, or sales for Client.
Perform business management functions including, but not limited to, accounting, tax, legal, or investment consulting.
Act as a therapist providing psychoanalysis, psychological counseling, or behavioral therapy.
Act as a public relations manager.
Act as a publicist to procure publicity, interviews, write-ups, features, or media exposure for Client.

Client understands that the relationship between the Parties is limited to the term of the Program. After the conclusion of the Program, no further relationship is presumed to exist unless a separate written agreement is entered into.

Earnings & Results Disclaimer

Every effort has been made to accurately represent this Program and its potential. There is no guarantee that you will earn any money or achieve any specific outcome using the techniques, ideas, and materials provided.

Any examples of earnings or results are not to be interpreted as a promise or guarantee.
Your level of success depends on many factors, including the time you devote to the Program, your finances, knowledge, skills, market, and personal effort.
We do not position this Program as a “get rich quick” or “instant success” scheme.

You are solely responsible for your decisions, actions, and results in life and business, and agree that Consultant is not liable for any outcomes or consequences.

Fees & Payment Options

By enrolling in the Program, Client agrees to pay the Program fee according to one of the following options:

Mentorship Program (Implement, Elevate, Ascend – 12-Month Mentorship)
Choose one:

One Pay: $3,300 (one-time payment)
Two Pay: $1,700 x 2 monthly payments
Three Pay: $1,180 x 3 monthly payments

By selecting a payment plan, you agree to complete all payments in full. Payment plans are not a “pay-as-you-go” or “cancel-anytime” option; they are a commitment to pay the entire agreed-upon Program fee over the specified number of installments.

Membership Option (Ongoing Access)

Membership: $299/month, billed monthly until canceled.

Membership includes access to Program content and group support as outlined in the current membership description at the time of enrollment. Features and inclusions may evolve over time as the Program grows.

Refunds, Cancellations & Guarantee

Mentorship Program (One Pay / Two Pay / Three Pay)

All mentorship Program sales are final.
No refunds are offered on the one-time payment or any payment plan installments once you enroll.
If you are on a payment plan, you are responsible for completing all agreed-upon payments, even if you choose to stop participating in the Program.

We strongly encourage prospective Clients to schedule a call or connect via phone/Zoom before enrolling to ask questions, discuss goals, and assess whether the Program is aligned with your expectations and needs.

Membership Option ($350/month)

There are no refunds for membership fees already charged.
You may cancel future membership billing by providing written notice (e.g., email) prior to your next billing date, according to the cancellation instructions provided in your membership portal or welcome materials.
Upon cancellation, your access to membership materials and community may end at the conclusion of your current billing period.

There are no guarantees of specific income, patient volume, or clinical outcomes associated with any Program or membership level.

Confidentiality

Client understands and agrees that:

Live calls (group and/or Q&A) may be recorded and saved in a private members area and/or training vault.
Recordings are for educational and training purposes for Program Participants.

The Consultant and Company respect Client’s privacy and insist that Client respects the privacy of the Company and other Program Participants (“Participants”). This is a mutual non-disclosure agreement.

Any confidential information shared by Participants or any representative of the Company is confidential, proprietary, and belongs solely and exclusively to the Participant who discloses it. Parties agree:

Not to disclose, reveal, or make use of any confidential information or any transactions, stories, or strategies discussed during the Program.
Not to share names, email addresses, titles or positions, phone numbers, or addresses of Participants or the Consultant with third parties without explicit permission.
Not to use any confidential information in any manner other than in connection with participation in the Program.

Additionally, Consultant agrees not to disclose Client’s confidential information to third parties, except as required by law.

No Transfer of Intellectual Property

All Program materials are copyrighted and original materials of the Company and/or Consultant.

Program content is provided for Client’s individual use only under a single-user license for the duration of their participation (and any access period described at enrollment).
Client may not reproduce, share, distribute, sell, or otherwise use Program materials for commercial purposes, teaching, or training others without express written permission from the Company.
All intellectual property, including but not limited to videos, PDFs, frameworks, templates, brand names, and course materials, remains the sole property of the Company.

Termination

Company is committed to providing all Clients with a positive Program experience. By enrolling, Client agrees that the Company may, at its sole discretion:

Limit, suspend, or terminate Client’s participation in the Program without refund or forgiveness of outstanding payments if Client:
- Becomes disruptive or disrespectful to the Company or Participants
- Fails to follow Program guidelines or community standards
- Impairs the participation of others in the Program
- Violates the terms of this Agreement or any posted community rules

If termination occurs under these circumstances, Client remains responsible for full payment of the Program fee as agreed at enrollment.

Acknowledgment

By enrolling in the Program, completing a purchase, or clicking to accept these terms, you acknowledge that you have:

Read and understood this Agreement
Agreed to the pricing, refund, and payment terms
Agreed to the limitations of liability and no-guarantee provisions
Agreed to abide by the guidelines, community standards, and boundaries set forth by the Company
